Correctable Violations and Certifying Agencies

A violation specified in Vehicle Code section 40303.5 may be dismissed upon proof of correction if none of the following conditions of exist: (Rule 850, California Rules of Court; Vehicle Code section 40610(b))

1. Evidence of fraud or persistent neglect;
2. The violation represents an immediate safety hazard;
3. The violator does not agree to or cannot promptly correct the violation.

Use the following guide to determine which Certifying Agency may certify your violation as having been corrected. Generally, the court clerk or DMV certifies registration and drivers license violations. Many commercial vehicle violations are not inspected by Court Services Division due to specialized training/equipment requirements. In those instances, you may obtain proof of correction from the agency that issued the citation (issuing agency) or the California Highway Patrol (CHP). Some violations handled by Court Services Division require a certificate from an Official Smog, Headlamp or Brake Station. (Refer to the California Bureau of Automotive Repair (BAR) at www.smogcheck.ca.gov or the telephone book yellow pages under “automotive repair, headlamp and brake inspection station” for inspection stations.
